  1. Der Lizenzgeber betreibt die bereitgestellte Plattform unter den Kriterien h\u00f6chstm\u00f6glicher Sorgfalt, Zuverl\u00e4ssigkeit und Verf\u00fcgbarkeit in Bezug auf Abonnementmodelle, 7 Tage die Woche, 24 Stunden am Tag, 365 Tage im Jahr.
    \nAusfallzeiten werden bei der Berechnung der Verf\u00fcgbarkeit nicht ber\u00fccksichtigt, wenn der Lizenznehmer diesen ausdr\u00fccklich schriftlich zugestimmt hat oder wenn es sich bei diesen Ausfallzeiten um Standardzeiten handelt, die in den Abs\u00e4tzen 4 und 5 genannt sind.<\/li>\n
  2. Der Lizenznehmer hat das Recht, die vereinbarte monatliche Geb\u00fchr um maximal 2 % f\u00fcr jeden vollen Prozentpunkt zu reduzieren, der unter der zugesicherten Verf\u00fcgbarkeit liegt. Weitergehende Anspr\u00fcche des Kunden bleiben unber\u00fchrt. <\/li>\n
  3. Ausfallzeiten f\u00fcr Wartung, Service und Upgrades werden zwischen den Parteien ausdr\u00fccklich schriftlich angek\u00fcndigt, wenn diese von den in den Abs\u00e4tzen 4 und 5 genannten Standardzeiten abweichen.<\/li>\n
  4. Die Wartung des Simplifier wird standardm\u00e4\u00dfig am Samstag von 22:00 bis 24:00 Uhr MEZ (Mitteleurop\u00e4ische Zeit) durchgef\u00fchrt. Abweichende oder zus\u00e4tzlich notwendige Wartungsarbeiten m\u00fcssen dem Lizenznehmer mindestens vier Wochen im Voraus schriftlich angek\u00fcndigt werden und bed\u00fcrfen der schriftlichen Zustimmung des Lizenznehmers. <\/li>\n
  5. Updates und Upgrades, die den Prozess \u00e4ndern, m\u00fcssen dem Lizenznehmer schriftlich und vor der Implementierung angek\u00fcndigt werden und bed\u00fcrfen der schriftlichen Genehmigung.<\/li>\n<\/ol>\n
